End User License Agreement
This End User License Agreement ("EULA") is a binding agreement between you and Egemen Sezen governing your use of Loopit Live. Please read it carefully before using the App.
1 · Parties
Licensor: Egemen Sezen · info@egemensezen.com · egemensezen.com
Licensee: You, the individual who has downloaded or purchased Loopit Live ("the App").
2 · Grant of License
Subject to the terms of this EULA, Egemen Sezen grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on Apple-branded devices that you own or control
- Use the App for your personal, non-commercial purposes
- Use the App on multiple devices associated with your Apple ID, as permitted by the App Store terms
This license does not include any right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App.
3 · Scope of License
Personal use
The App is licensed for personal use. You may use the App to create musical content for any purpose, including commercial recordings and performances, provided the use is of the App itself and not a redistribution of the App's software.
Family Sharing
If the App is made available through Apple's Family Sharing feature, each member of your family group may use the App on their own devices under the terms of this EULA.
No transfer
You may not rent, lease, lend, sell, redistribute, or sublicense the App. You may not copy the App except as expressly permitted by this EULA and the App Store Terms of Service.
4 · Restrictions
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except as permitted by applicable law
- Create derivative works based on the App
- Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) in the App
- Use the App to build a competing product or service
- Use the App in any way that violates applicable laws or regulations
- Circumvent any technical protection measures in the App
5 · Ownership
The App is licensed, not sold. Egemen Sezen retains all right, title, and interest in and to the App, including all intellectual property rights. You acknowledge that no title or ownership in the App is transferred to you.
You retain full ownership of all audio recordings, MIDI sequences, project files, and other creative content you produce using the App. Egemen Sezen claims no rights over your creative output.
6 · Consent to Use of Data
You agree that Egemen Sezen may collect and use technical data and related information — including technical information about your device, system, and application software — to facilitate updates, support, and other services related to the App. This data is collected in an anonymized form that does not identify you personally. 7 · Updates
Egemen Sezen may provide updates, upgrades, or patches to the App from time to time. Such updates may be required to continue using the App and may be delivered automatically. This EULA applies to all updates unless a separate license agreement accompanies the update.
8 · Term and Termination
This EULA is effective from the date you first download or use the App and remains in effect until terminated.
Egemen Sezen may terminate this EULA immediately and without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy all copies in your possession.
You may terminate this EULA at any time by deleting the App from all your devices.
9 · Disclaimer of Warranties
Egemen Sezen does not warrant that the App will meet your requirements, operate without interruption, be error-free, or that defects will be corrected.
10 · Limitation of Liability
To the maximum extent permitted by applicable law, Egemen Sezen, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including but not limited to loss of data, loss of profits, loss of goodwill, or business interruption, even if advised of the possibility of such damages.
Egemen Sezen's total liability to you for all claims arising from or relating to this EULA shall not exceed the amount you paid for the App.
11 · Apple's Role
You acknowledge and agree that:
- This EULA is concluded between you and Egemen Sezen only, and not with Apple Inc.
- Apple is not responsible for the App or its content
- Apple has no obligation to furnish maintenance or support services for the App
- Apple is not responsible for addressing any claims by you or any third party relating to the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App
- Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary thereof
12 · Governing Law & Dispute Resolution
This EULA shall be governed by the laws of the Republic of Turkey. Any disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
13 · Entire Agreement
This EULA, together with the Privacy Policy and Terms of Use, constitutes the entire agreement between you and Egemen Sezen with respect to the App and supersedes all prior agreements and understandings.
